EACH CONSIGNMENT OF COAL SHALL BE DELIVERED IN ACCORDANCE WITH THE FOLLOWING PROCESS:
The parties will agree on a consignment delivery schedule in batches that will specify the price, metric tons to be supplied, coal speci cation and delivery point inclusive of nominated vessel and port
The Buyer shall provide a validated letter of credit cover the forecast purchases in the relevant Payment Window for such payments. The Buyer shall send proof of payment to the Seller.
The legal Agent shall con rm the availability of funds on request of the Seller in the amount requested
2KP shall have at least one representative present at the loading site (mine site) and be present at the Coal stockpile at the loading site until the Independent Assayer, namely SGS or similar, has issued an assay certi cate, at the Buyer’s cost, con rming the chemical nature and composition of the Coal to be delivered.
Upon delivery of the coal, the loading and weighing certi cates (in terms of standard industry practices) issued by the loading site operator shall be conclusive proof of the amount of Coal delivered for invoicing purposes by the Seller.
2KP shall ensure stockpile transportation and security at designated siding. The company shall ensure management of transfer of product onto contracted rail transportation via route to designated port.
2KP shall have at least one representative present at the port to ensure management and security of stockpile and readiness for loading onto nominated vessel via contractual obligation by third party port facility
